Tenant Information

Registering:

You can register with us on the internet or over the telephone. Please provide us with all your contact details including your email address. We update our property list on a daily basis so you have a good knowledge of what is available.

Viewings:

Property viewings are booked through our team between the hours of 9:30am to 6pm Monday to Friday. We can undertake evening viewings up until 7pm Monday to Friday and operate on a pre-booked appointment only basis during Saturdays. We are closed on Sundays and Bank Holidays.

Tenant Fee Schedule

Holding Deposit:

When you have selected a suitable property through us, we will ask you to set a move in date for your chosen property and we will set a ‘deadline for agreement’ date to ensure contracts are signed prior to your move in date. Once this has been agreed we will require one weeks holding deposit in order for us to take the property off of the market and begin the reference and credit checks on all tenants.

If the landlord withdraws from the proposed tenancy before the tenancy agreement is signed by both parties; subsequently missing the ‘deadline for agreement’, you will receive a full refund of the original holding deposit paid within seven days of the landlord withdrawing.

The tenant(s) will forfeit the 1 week holding deposit should the following occur:

  • If the tenant provides false or misleading information. This can include a tenants behaviour in providing false or misleading information.
  • If the tenant fails Referencing and/or fails a Right to Rent Check (causes may include the tenant(s) having a bad credit rating, County Court Judgements, previous missed rental payments, leaving previous property in bad condition, not earning 2.5x your gross salary for referencing criteria, not being allowed to reside, work or live in the United Kingdom etc..)
  • If the tenant withdraws from the tenancy before the contracts are signed
  • If the tenant does not enter the agreement by the deadline for agreement
  • If the tenant fails to take all reasonable steps to enter into a tenancy agreement

Hackett Estate Agents (Hackett UK Ltd) will set out in writing if we intend to retain a tenants (or relevant persons) holding deposit within 7 days of deciding not to rent the property to them if this decision is before the ‘deadline for agreement’ or within 7 days of the ‘deadline for agreement’ passing.

Security Deposit: (per tenancy. Rent under £50,000 per year):
Five weeks’ rent: The covers damages of defaults on the part of the tenant during the tenancy.

Security Deposit: (per tenancy. Rent over £50,000 per year):
Six weeks’ rent: The covers damages of defaults on the part of the tenant during the tenancy.

Unpaid Rent:
Interest is charged at 3% above the Bank of England Base Rate from the Rent Due Date until paid in order to pursue non-payment of rent. Please note: This will not be levied until the rent is more than 14 days in arrears.

Lost Key(s) or other Security Device(s):
Tenants are liable to the actual cost of replacing any lost key(s) or other security device(s). If the loss results in locks needing to be changed, the actual costs of a locksmith, new lock and replacement keys for the tenant, landlord and any other persons requiring keys will be charged to the tenant. If extra costs are incurred there will be a charge of £15 per hour (inc VAT) for the time taken replacing lost key(s) or other security device(s).

Variation of Contract: (Tenants Request)
£50 (inc VAT) per agreed variation. To cover the costs associated with taking landlord’s instructions as well as the preparation and execution of new legal documents.

Change of Sharer: (Tenants Request)
£50 (inc VAT) per replacement tenant or any reasonable costs incurred if higher. To cover the costs associated with taking landlord’s instructions, new tenant referencing and Right-to Rent checks, deposit registration as well as preparation and execution of new legal documents.

Early Termination: (Tenants Request)
Should the tenant wish to leave their contract early, they shall be liable to the landlord’s costs in re-letting the property, as well as all rent due under the tenancy until the start date of the replacement tenancy. These costs will be no more than the maximum amount of rent outstanding on the tenancy.

References & Right to Rent Certificate Application:

We require a full reference check of all prospective tenants using our chosen independent reference company. A Guarantor reference will be required should the tenant(s) fail referencing or be deemed financially weak. The Guarantor must reside in the United Kingdom.

Tenants and Guarantors must be aware that in order to pass reference checks their individual or combined / joint gross salary will need to be 2.5x the total gross annual rent of the property they are planning to rent or guarantee. They also need to ensure they have no outstanding CCJ’s, do not have a poor credit rating or likely to receive a bad landlord reference (which may occur if there have been previous missed or late rent payments or having left a property in a bad condition).

Under the Immigration Act 2014 (S32 (6)(a)) the immigration status of all tenants must be checked and verified before a tenancy can commence. Tenants need to ensure that they have the correct legal ‘Right to Rent’ status to reside in the United Kingdom. Tenants must ensure that they do not provide misleading information or knowingly provide false information regarding their ‘Right to Rent’ status in the United Kingdom. Failure to do so will result in the forfeit of their Holding Deposit and the tenancy not proceeding.

Inventory, Check In & Check Out:

If the landlord has a professional inventory created for the property, the landlord is responsible for the cost of the Inventory, Check In and Check Out reports. Tenants are expected to arrange a suitable time with the Inventory clerk (within the inventory companies normal working hours) to arrange the formal Check In and Check Out of a property.

Tenancy Agreement:

The tenancy agreement that you will sign is a legally bound document. You will receive a specimen agreement before you pay a holding deposit to Hackett UK Ltd in order to make you aware of the terms set out within the document you will expected to sign. Before signing any tenancy agreement please ensure you read all legal documentation given to you thoroughly.

Hackett Estate Agents (Hackett UK Ltd) will comply with all applicable requirements of the Data Protection Legislation and will process your personal data (as defined in the Data Protection Legislation) as set out in its Privacy and Cookie Notice which is available at http://www.hackett-estates.com/ . The lawful basis for such processing is the performance of a contract. Data Protection Legislation means a) until 25 May 2018, the Data Protection Act 1998; and (b) (i) unless and until the GDPR is no longer directly applicable in the UK, the GDPR and any national implementing laws, regulations and secondary legislation, as amended or updated from time to time, in the UK and then (ii) any successor legislation to the GDPR or the Data Protection Act 1998; and, GDPR means the General Data Protection Regulation ((EU) 2016/679).
